Booking Terms

Effective 15 May 2026 — applies to Renters

These Booking Terms govern the relationship between [PLATFORM ENTITY NAME] LIMITED (the "Platform", "we", "us") and a person who books a boat rental through the Platform (a "Renter", "you"). They sit alongside our Terms of Service, Privacy Policy, Cookie Policy, Cancellation Policy, and Acceptable Use Policy.

By making a Booking you agree to these Booking Terms.

1. What we are and what we are not

1.1 The Platform is an online marketplace connecting Renters with independent boat owners ("Owners") in Cyprus.

1.2 We are not a boat operator, charter company, or insurer. We do not own, maintain, captain, or insure any Vessel listed on the Platform.

1.3 The actual rental contract is between you and the Owner ("Rental Agreement"). Our standard Rental Agreement template sets out the minimum terms; the Owner may add Listing-specific terms not inconsistent with the template.

2. Bookings

2.1 To book a Vessel you must be at least 18 years old, have a valid email address, and provide accurate identity and (where applicable) licence information.

2.2 You make a Booking by selecting dates, the number of guests, any add-ons, and confirming payment. A Booking is confirmed only when (a) the Listing is set to instant-book and you complete payment, or (b) where it is not instant-book, the Owner accepts the Booking within 24 hours and you complete payment.

2.3 You may book a Vessel no less than two (2) hours before the scheduled start time and no more than 365 days in advance, subject to the Owner's availability calendar.

2.4 The total price shown at checkout includes the rental price set by the Owner plus the Platform's 5% Renter Service Fee. Any Security Deposit is shown separately and held until 24 hours after rental end.

3. Payment

3.1 Payments are processed by Stripe. By submitting a payment you authorise the Platform (via Stripe) to charge your payment method for the rental price, the Renter Service Fee, and any Security Deposit.

3.2 If your bank or card issuer declines the charge or reverses it, the Booking may be cancelled and the Vessel released back to availability.

3.3 Fuel surcharges, mooring fees, and any other amounts that the Listing states are payable directly to the Owner at handover are not processed through the Platform. The Owner will collect those amounts and issue a receipt.

4. Cancellations and refunds

The applicable refund schedule is set out on the Cancellation Policy page. Each Listing displays which of the five standard policies (Flexible, Moderate, Strict, Super Strict, Non-Refundable) applies.

5. No statutory right of withdrawal

Boat rentals are dated leisure / accommodation services. Under Article 16(l) of Directive 2011/83/EU (the Consumer Rights Directive) and the equivalent Cypriot implementing law, the 14-day right of withdrawal does not apply to services that are to be performed on a specific date or period (this includes boat rentals, accommodation, car hire, catering, and leisure activities). Your cancellation rights are governed by the Cancellation Policy.

By confirming the Booking you acknowledge this exclusion.

6. At the handover

6.1 You must arrive at the agreed handover location at the agreed time. If you arrive more than 60 minutes late without prior notice and cannot be reached, the Owner may treat you as a no-show. No refund is payable in that case.

6.2 You must present a valid boating licence where required (see §4.3 of the Boat Owner Listing Agreement and the Listing). If your engine power exceeds the bareboat threshold and you do not hold a valid licence, the Owner is required by law to refuse to release the Vessel; this counts as a Renter no-show.

6.3 You will be asked to sign the Owner's Rental Agreement (based on our template) and confirm the pre-rental condition record. Refusing to sign may result in the Owner refusing to release the Vessel.

6.4 You will receive a documented safety briefing covering, at minimum: life jackets, no-go zones, the 5-knot harbour speed limit, alcohol limits, navigation lights, and distress procedures. You may not depart the harbour without receiving and acknowledging the briefing.

7. During the rental

7.1 You must operate the Vessel responsibly, comply with Cypriot maritime law (including alcohol limits and speed limits), and respect the rules in the Listing and the Rental Agreement.

7.2 You are responsible for the safety of all guests on board.

7.3 You may not use the Vessel for any commercial purpose, illegal activity, racing, towing of unauthorised water-toys, or in conditions the Owner has identified as unsafe.

8. Damage, loss, and the Security Deposit

8.1 You are responsible for damage to or loss of the Vessel during the rental period that goes beyond fair wear and tear.

8.2 The Owner may notify a claim against the Security Deposit within 24 hours of rental return, via the Platform's damage report tool. You will be notified and may respond.

8.3 The Platform will release the Security Deposit (or any undisputed remainder) to you 24 hours after rental return, less any agreed or determined deductions. Disputed amounts are held pending the dispute process in §10.

9. Liability

9.1 Subject to mandatory law (including consumer protection law and liability for death or personal injury caused by negligence), the Platform's aggregate liability to you under or in connection with these Booking Terms shall not exceed the total amounts you have paid us for the Booking giving rise to the claim.

9.2 The Platform is not liable for the acts or omissions of any Owner. Your remedies for issues with the Vessel, the rental, or the conduct of the Owner are primarily against the Owner under the Rental Agreement; we will assist via the dispute process in §10.

9.3 Nothing in these Booking Terms excludes or limits any liability that cannot lawfully be excluded.

10. Disputes

10.1 If you have a complaint, please contact us first at support@cyprusboatrental.com. We will acknowledge within two (2) business days and aim to resolve within ten (10) business days.

10.2 EU consumers may also use the European Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr.

10.3 Nothing in this clause prevents you from bringing proceedings in the courts of your place of habitual residence as permitted under EU consumer protection law.

11. Changes

We may amend these Booking Terms from time to time. The version in force on the date you make a Booking governs that Booking; changes do not apply retroactively.

12. Governing law

These Booking Terms are governed by the laws of the Republic of Cyprus, without prejudice to any mandatory consumer protection rules of the country in which you are habitually resident.
