Standard Rental Agreement (Template)

Template version 15 May 2026 — entered into at handover between Owner and Renter

This is the standard template that every Rental Agreement formed through cyprusboatrental.com is based on. Each Owner may add Listing-specific terms (e.g., fuel rules, water-toys, no-go zones) that are not inconsistent with this template. The Platform is not a party to this Agreement; it is between the Owner and the Renter directly.

6. Permitted use, area, and conditions

6.1 Operating area: ____________________________________ (sea area / max distance from marina / no-go zones).

6.2 The Vessel may not leave the operating area without the Owner's prior written consent.

6.3 The Renter shall comply with Cypriot maritime law at all times, including:

  • 5-knot speed limit within harbours and within 200 m of bathing beaches
  • Alcohol limits for operators (0.05 % BAC) — operator must remain sober
  • Carrying and using life jackets for every person on board, including children
  • Respect of protected areas (Akamas, marine reserves) and any seasonal restrictions

7. Licence and competency

7.1 If the engine power exceeds 30 HP and the rental is bareboat (self-drive), the Renter must either:

  • (a) Hold a valid recognised boating licence (ICC / RYA Day Skipper or above / EU national licence / Cyprus HSSV); or
  • (b) Be a temporary visitor to Cyprus for fewer than 30 days and sign the competency declaration in Schedule A following a documented safety briefing.

7.2 The Owner has copied / retained: ☐ licence ☐ signed competency declaration ☐ neither (skippered rental).

8. Safety briefing (Renter to initial)

The Renter confirms they have received and understood a briefing covering:

  • Life jackets — location and use; mandatory for children at all times
  • No-go zones and operating-area limits
  • 5-knot harbour speed limit and beach proximity rules
  • Alcohol prohibition for the operator
  • Navigation lights and night-use rules
  • Anchoring procedure
  • Distress procedures: VHF Ch. 16, Joint Rescue Coordination Centre (JRCC) tel. +357 22 803 100, Owner emergency tel. ____________________________________
  • Onboard equipment: location of flares, first aid, fire extinguisher, bilge pump

10. Renter undertakings

  • Operate the Vessel with reasonable care and skill;
  • Not use the Vessel for commercial purposes, towing, racing, illegal acts, or unauthorised water-toys;
  • Carry no more than the maximum number of persons stated in the Listing (Maximum: _____ guests including children);
  • Return the Vessel on time, at the agreed marina, with the agreed fuel level (or pay refuelling charges);
  • Notify the Owner immediately of any incident, damage, or near-miss.

11. Owner undertakings

  • Deliver the Vessel in seaworthy condition with all required safety equipment;
  • Hold the insurance described in §3.1 of the Boat Owner Listing Agreement;
  • Provide the safety briefing in §8 and the emergency contact;
  • Respond to the Renter's reasonable contact attempts during the rental.

12. Damage, loss, and Security Deposit

12.1 The Renter is liable for damage to or loss of the Vessel beyond fair wear and tear during the rental, up to the value of the Security Deposit for non-negligent damage and without limit for damage caused by:

  • breach of §6 (operating outside the area / unlicensed operation);
  • operation under the influence of alcohol or drugs;
  • wilful misuse;
  • failure to follow the safety briefing.

12.2 The Owner may notify a deduction claim within 24 hours of rental return via the Platform's damage report tool. The Platform will hold the Security Deposit pending the claim. Disputes are handled under the Platform's dispute resolution process.

12.3 Where damage exceeds the Security Deposit, the Owner and the Renter shall resolve the excess directly, and may rely on the Owner's hull / liability insurance. The Renter agrees to cooperate with any insurance claim, including providing a statement and photographs.

13. Cancellation

This Rental Agreement is terminated automatically if the Booking is cancelled in accordance with the Platform's Cancellation Policy.

14. Force majeure / safety cancellations

If at any time the Owner reasonably determines that weather, sea state, mechanical issues, or other circumstances make the rental unsafe, the Owner may abort or shorten the rental and return to harbour, decline to depart, or substitute a rescheduled date. No additional charge is made to the Renter in such cases. Refund handling follows the Cancellation Policy.

15. Limitation of liability

15.1 Nothing in this Agreement excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under Cypriot law.

15.2 Subject to §15.1, neither party is liable to the other for indirect or consequential loss (loss of profit, loss of holiday enjoyment beyond statutory compensation rights, etc.).

16. Governing law

This Agreement is governed by the laws of the Republic of Cyprus. The parties submit to the non-exclusive jurisdiction of the courts of Cyprus.

SCHEDULE A — Competency Declaration (visitors only)

(Use only if the Renter does not hold a recognised boating licence and is a visitor to Cyprus for fewer than 30 days.)

  • I have read and understood the safety briefing delivered today, including the items in §8 of the Rental Agreement.

  • I am not under the influence of alcohol or drugs and will not operate the Vessel while under such influence.
  • I will comply with Cypriot maritime law and the rules of the Operating Area set out in §6.
  • I have practical experience operating a small motor vessel and confirm I am competent to operate this Vessel safely.
