1. Acceptance of Terms
By accessing or using the CyprusBoatRental platform at cyprusboatrental.com (the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree with any part of these Terms, you must not use the Platform. These Terms apply to all visitors, registered users, boat owners ("Hosts"), and renters ("Guests").
2. Account Registration
To use certain features of the Platform, you must create an account. When registering, you agree to:
- Provide accurate, current, and complete information.
- Keep your login credentials confidential and secure.
- Be responsible for all activity that occurs under your account.
- Notify us immediately of any unauthorised use of your account.
- Be at least 18 years old or the age of majority in your jurisdiction.
We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.
3. Booking & Payments
CyprusBoatRental facilitates bookings between Hosts and Guests. When a booking is made:
- The Guest pays the total amount at the time of booking through our secure payment processor (Stripe).
- Funds are held securely and released to the Host after the trip commences.
- A service fee is charged to cover platform operations and payment processing. This fee is non-refundable.
- Prices displayed on listings include the rental fee. Service fees and any applicable taxes are shown at checkout before confirmation.
- CyprusBoatRental is not a party to the rental agreement between Host and Guest. We act as an intermediary platform.
4. Cancellation & Refunds
Each listing specifies a cancellation policy chosen by the Host:
- Flexible: Full refund if cancelled at least 24 hours before the trip.
- Moderate: Full refund if cancelled at least 5 days before the trip.
- Strict: 50% refund if cancelled at least 7 days before the trip.
- Non-Refundable: No refund after booking confirmation.
If a Host cancels a booking, the Guest receives a full refund including all fees. In cases of adverse weather conditions that make the trip unsafe, refunds or rescheduling will be handled on a case-by-case basis. Service fees are non-refundable unless CyprusBoatRental cancels or a Host-initiated cancellation occurs.
No EU 14-day right of withdrawal: Boat rentals are leisure services provided on a specific date or for a specific period of performance. Pursuant to Article 16(l) of Directive 2011/83/EU (the Consumer Rights Directive) and the corresponding Cyprus implementing law, the 14-day right of withdrawal does not apply to such contracts. The cancellation rules above replace any general cooling-off period. This does not affect your statutory rights in case of non-conformity or force majeure. 5. Host Responsibilities
As a Host on CyprusBoatRental, you agree to:
- Provide accurate and up-to-date information about your boat, including photos, specifications, pricing, and availability.
- Ensure your boat is seaworthy, well-maintained, and equipped with all required safety equipment (life jackets, fire extinguisher, first aid kit, navigation lights).
- Hold valid insurance coverage for charter use of your vessel.
- Comply with all applicable local, national, and maritime laws and regulations in Cyprus.
- Provide a safety briefing to Guests before departure.
- Respond to booking requests within 24 hours.
- Report any incidents or damage promptly to CyprusBoatRental and relevant authorities.
6. Renter Responsibilities
As a Guest on CyprusBoatRental, you agree to:
- Provide accurate personal information and any required documentation (e.g., boating license) when requested.
- Treat the vessel with care and return it in the same condition as received.
- Follow all safety instructions provided by the Host or skipper.
- Not exceed the maximum passenger capacity stated in the listing.
- Comply with all maritime laws, including regulations on alcohol consumption, speed limits, and restricted areas.
- Be responsible for any damage caused by negligence or misuse during the rental period.
- Report any pre-existing damage or issues to the Host before departure.
7. Insurance
CyprusBoatRental requires all Hosts to maintain valid insurance for their vessels that covers charter use. However, CyprusBoatRental does not provide insurance directly and is not responsible for the adequacy of any Host's insurance coverage. Guests are strongly advised to obtain their own travel and liability insurance before renting a boat. In the event of an incident, claims should be directed to the relevant insurance provider.
8. Limitation of Liability
CyprusBoatRental operates as a marketplace connecting Hosts and Guests. To the maximum extent permitted by law:
- We are not liable for any injuries, damages, losses, or costs arising from the use of boats listed on the Platform.
- We do not guarantee the safety, quality, legality, or suitability of any listing, Host, or vessel.
- Our total liability to any user shall not exceed the amount of service fees paid by that user in the 12 months preceding the claim.
- We are not liable for indirect, incidental, consequential, or punitive damages.
9. Dispute Resolution
If a dispute arises between a Host and a Guest, we encourage both parties to first attempt resolution through our in-platform messaging system. If a resolution cannot be reached, CyprusBoatRental may mediate at its discretion. For unresolved disputes, the parties agree to submit to binding arbitration under the laws of the Republic of Cyprus. Any legal proceedings shall be conducted in the courts of Limassol, Cyprus.
EU Online Dispute Resolution: Pursuant to Regulation (EU) 524/2013, the European Commission provides an online platform for the resolution of consumer disputes available at https://ec.europa.eu/consumers/odr/. Our contact email for ODR communications is support@cyprusboatrental.com. We are not obliged and not willing to participate in proceedings before a consumer arbitration board.
9a. Illegal Content & Notice-and-Action (DSA)
CyprusBoatRental complies with Regulation (EU) 2022/2065 (the Digital Services Act). Any person may notify us of allegedly illegal content via our Notice and Action page.
- Notices are reviewed without undue delay in a diligent, non-arbitrary and objective manner.
- Where action is taken, we provide a clear statement of reasons to the affected user and an internal appeals mechanism.
- Our single point of contact for users and authorities under Articles 11 and 12 is support@cyprusboatrental.com.
- Hosts must self-declare as either private individuals or traders under Article 30; trader hosts must provide accurate company identification details before listing.
10. Privacy
Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data. By using the Platform, you consent to data practices described in the Privacy Policy.
11. Modifications to Terms
CyprusBoatRental reserves the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. Continued use of the Platform after changes are posted constitutes acceptance of the revised Terms. We may notify registered users of material changes via email.
